Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of SPHERES, a digital evolution engineering platform operated by Evolution Engineering (“we”, “us”, or “our”). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

SPHERES is a software-as-a-service (SaaS) platform that enables organizations to model digital ecosystems, generate AI-powered evolution strategies, engineer multi-agent teams and capabilities, and orchestrate continuous business modernization. The Service is provided over the internet and accessed via web browsers at spheres.evolutionengineering.ai.

2. Eligibility and Account Registration

You must be at least 16 years of age to use the Service. By registering you represent that the information you provide is accurate and that you will keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or connected systems.
  • Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use automated means (bots, scrapers) to access the Service except through APIs we explicitly provide.
  • Transmit malicious code, spam, or any content that infringes the rights of others.

4. Intellectual Property

All rights, title, and interest in the Service — including its software, design, branding, and documentation — remain the exclusive property of Evolution Engineering. You retain ownership of any content you create within the Service. By using the Service you grant us a limited license to host, store, and process your content solely for the purpose of providing the Service to you.

5. Subscriptions, Billing, and Refunds

Access to certain features requires a paid subscription. Subscription fees are billed in advance on a recurring basis (monthly or annually) according to the plan you select. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are handled on a case-by-case basis at our discretion.

6. Service Communications and Messaging Policy

SPHERES may send you operational notifications related to your use of the Service through multiple communication channels, including email, SMS, Slack, and WhatsApp. These messages cover human-in-the-loop task approvals, workflow status updates, system alerts, and other service-critical notifications.

6.1 Opt-In Only

You will only receive messages on channels you have explicitly opted into. Communication preferences are managed entirely from your Profile page within the Service. No messages are sent on any channel until you enable it.

6.2 No Marketing Messages

We do not send marketing, promotional, or advertising messages through any communication channel. All messages are strictly operational and directly related to actions you have initiated or workflows you are participating in.

6.3 Message Frequency

Message frequency varies based on your activity within the Service. You will only receive messages when an action requires your attention — such as a task approval, an escalation, or a workflow completion. There are no scheduled or recurring promotional messages.

6.4 Message and Data Rates

SPHERES does not charge you for any messages sent through the Service ($0 cost to users). However, standard message and data rates from your mobile carrier or internet service provider may apply to SMS messages and data usage. Contact your carrier for details about your plan.

6.5 How to Opt In

To receive notifications on a specific channel, navigate to your Profile page and enable the desired communication channels (Email, SMS, Slack, or WhatsApp). You can enable or disable each channel independently at any time.

6.6 How to Opt Out

You can opt out of messages at any time using any of the following methods:

  • Navigate to your Profile page and disable the communication channel you no longer wish to receive messages on.
  • For SMS: reply STOP to any message to immediately unsubscribe from SMS notifications.
  • For SMS: reply HELP to any message to receive support information and instructions.
  • Contact us at support@evolutionengineering.ai to request opt-out from any or all channels.

Opting out of a channel does not affect your access to the Service. Core account notifications (such as password resets and critical security alerts) may still be delivered to your registered email address as required for account security.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service you acknowledge that you have read and understood the Privacy Policy.

8. Third-Party Services

The Service integrates with third-party providers for infrastructure, authentication, payment processing, AI model execution, and messaging delivery. These integrations are used solely to operate the Service. We are not responsible for the practices or availability of third-party services, and your use of them may be subject to their own terms.

9. Service Availability and Modifications

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features of the Service at any time. We will make reasonable efforts to notify you of material changes that affect your use.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Evolution Engineering shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify, defend, and hold harmless Evolution Engineering and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion, with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will remain in effect.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Evolution Engineering is incorporated, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on this page and updating the effective date above. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
